Payment Terms
Because of our quick turnaround, all print and design orders must be prepaid in full. We reserve the right to refuse completion or delivery of work until past due balances are paid. For Web design orders, half of the total project cost will be due up front along with any service fees such as Domain or Hosting. After the final revisions are made, the client is expected to provide the 2nd and final half before the site is made public.
Quotes
The Client agrees to pay Volta Design Studios in accordance with the terms specified in each proposal/quote. Once quote/invoice is approved work can begin.
Cancellations
Cancelled orders can only be cancelled at the end of the same business day ordered. If you cancel your order while in production after closing hours (5:00pm) you will not receive a refund.
Artwork Given / Digital Images
It is the client's responsibility to maintain a copy of the original computer files and artwork. Volta Design Studios is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Volta Design Studios can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates.
Rights of Ownership
Once a project has been delivered by us and is fully paid for by the client, Volta Design Studios will assign the reproduction rights of the design for the use(s) described in the quote/proposal. According to the Copy right Law of 1976, the rights to all design and artwork, including but not limited to photography and or illustration created by independent photographers or illustrators retained by designer, or purchased from a stock agency on your behalf, remain with the individual designer, artist, photographer or illustrator. Unless a purchase of “All Rights” (A Buyout) is negotiated with Volta Design Studios and/or our authorized representative, you may not use or reproduce the design or the images therein for a purpose other than the one(s) originally stipulated. If you wish to use the design we have created and/or the images within it for another purpose or project, including a reprint or exhibition, you must contact us to arrange the transfer of rights and any additional fees before proceeding. If printing or other implementation is done through your vendors, you agree to return to us all our original mechanicals and artwork (prints, drawings, webwork, etc.) within two weeks, and to provide us with printed samples of each project.
Accuracy of Specifications
The customer agrees to exercise due diligence in its direction to us regarding preparation of materials and must be able to substantiate all claims and representations. You are responsible for all trademark, service mark, copyright and patent infringement clearances. You are also responsible for arranging, prior to publication, any necessary legal clearance of materials we prepare.
Revisions / Corrections
Client corrections must be specified in writing (written or oral) or “ok’d” via email and must include all corrections or changes from the original specifications. This will constitute an agreement between us. You are allowed up to 2 Revisions after a concept is presented. Any revisions requested after will be charged at our current rates unless specified otherwise.
Under-runs / Over-runs
Volta Design Studios, normally overrun the amount of materials specified by the client or client suppliers. The client will not be charged for the extra printed materials but in an event of an under-run, Volta Design Studios will simply bill you for the delivered amount.
Delivery
All orders are to be picked up when completed at our Houston location. We can arrange a Courier to deliver certain orders at the client’s expense.
Printing Claims
Claims for defects, damages, or shortages must be made by the client in writing no later than 5 calendar days after the products have been picked up or delivered. If no such claim is made, Volta Design Studios and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that Volta Design Studios performance has fully satisfied all terms, conditions and specifications.
Third Party Printing
Volta Design Studios shall have the right to assign any portion of the work required to another contractor.
Samples
Volta Design Studios may use your project for samples or advertising purposes.
Changes to Our Terms and Conditions
Volta Design Studios may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was last changed on May 13th, 2010.
